I have represented many clients who have been injured, become ill, or required hospitalization and medical treatment as a result of food poisoning. The most important factor in a food poisoning case is documentation. Unfortunately, many of these cases are misdiagnosed as the stomach flu, but studies have shown that in most cases, the stomach flu is really a form of food poisoning. After you have eaten at a restaurant and experience nausea, stomach cramps, vomiting or diarrhoea, the first diagnoses is probably food poisoning.
Very often there is no way to prove directly which specific food or meal that you ate caused the food poisoning, especially when the sickness presents itself a significant amount of time later. Fortunately, in some of my cases, we have been able to get the Department of Health involved who were able to establish that unsafe food handling and/or storage practices at the restaurant. This violation is a huge issue and puts a lot of pressure on the restaurant and their insurance company to settle the case quickly.
I had two very large cases involving food poisoning that occurred on the same evening at a chinese restaurant in the Los Angeles area. There were two functions going on at the same time in the restaurant, the first being a child’s birthday party with over a hundred people in attendance, and the second, an engagement party of about fifty people. Later on that night and the next day, dozens of the guests from both of these separate banquets became ill and several were hospitalized for up to a week with.

The first of these violations was that ingredients were being stored at unsafe temperatures allowing harmful bacteria to grow on the food. The second was cross contamination between raw and cooked food that was caused by using the same wood or ceramic surface to prep the raw ingredients and cut up the cooked food before plating. In this case, because so many people had become ill, and we had the documentation from the Health Department regarding these violations, there was no question that the food poisoning had been caused by the banquet meals. We were able to resolve this food poisoning incident with a rather large settlement, exceeding 500,000 dollars for all the cases combined.
I have also had cases that involved grocery stores that had sold food that was stored at unsafe temperatures resulting in food poisoning. Once again, very important to report suspected food poisoning as promptly as possible so that investigations might reveal any violations that may be the source of your sickness.
